Music Lessons
This form is for anyone wishing to begin private music lessons with Paul Emmett.
Lessons are available for both children and adults, covering a range of instruments and musical disciplines. Places are limited and will be offered on a first-come, first-served basis. If no space is currently available, you’ll be added to the waiting list and contacted when a place becomes free.
This form serves as a contract between you and Paul Emmett. Please read the details carefully, and get in touch if you have any questions.
Once completed, you’ll receive a personal login for the Student Portal (and Parent Portal, where applicable) via MyMusicStaff.
Terms and Conditions
Please read these carefully. If you have any questions, please feel free to get in touch.
Lesson Times
Lessons will be given weekly during term time on a flexible basis, generally on the same day. However, depending on the teacher’s and the school’s availability, this may change occasionally. Where possible, advance notice of any changes will be made. Lessons are charged at a rate of £30 per hour, pro rata for any part of an hour. The teacher may increase the tuition fees from time to time and will give written notice of such an increase at least one term (6 school weeks) prior to the increase taking effect.
Conditions of Music Tuition
The conditions set out in this section will apply to this agreement between Paul Emmett and the Parent or Carer named previously.
When this agreement is completed by the Parent or Carer of the Pupil, it will constitute a legally binding contract between the Parent or Carer and Paul Emmett.
However, the Parent or Carer will have the right to cancel this agreement within 14 days from the day after the date of this agreement by giving written notice of cancellation to the teacher. If the agreement is cancelled within the 14-day cancellation period, the Parent or Carer is required to pay the fees for any lessons delivered, and any other fees paid to the teacher will be refunded.
Once the 14-day cancellation period has expired, the Agreement will remain in force continuously unless terminated in accordance with Condition 5.
1. Lessons
The teacher will give the lessons at the times previously detailed according to the teacher’s and the school’s availability, generally on a weekly basis on a rolling rota system during the school day. Regular feedback will be given via the email address provided.
The Triangle of Music Lessons
The best results come when everyone works together:
Teacher – provides lessons, teaches appropriate material, and gives feedback
Pupil – comes prepared, practices regularly, and embraces learning
Parent/Carer – supports practice at home and pays promptly
2. Payment of Fees
The Parent or Carer of the Pupil will pay for lessons within 7 days of receipt of the invoice from the Teacher. An invoice will be sent towards the end of each calendar month relating to any lessons received in that month.
3. Missed Lessons
The Parent or Carer of the Pupil will notify the teacher at the earliest possibility if the Pupil is not going to be in school. In many situations, the teacher will liaise with the school office regarding trips or other events within the school year which may cause missed lessons and these will not be charged. In the case of unauthorised absences or holidays within term time, the lessons may still be charged. If the teacher cancels a lesson, the lesson will either be rescheduled for an alternative day that week, and if that cannot be achieved, the lesson will not be charged.
4. Examinations, Competitions and Public Performances
The Pupil will not be entered for any examinations, competitions, or public performances without the prior consent of the Teacher, the Pupil and the Pupil’s Parent or Carer.
5. Termination of Tuition
This Agreement may be terminated under any of the following conditions:
(a) by the Parent or Carer giving one school term’s notice (6 weeks). Lessons will continue during the notice period, and will be charged during that time.
(b) by mutual consent at any time by the Teacher and the Parent or Carer, signing and dating a written statement to that effect.
(c) where fees are not paid on time, the Teacher reserves the right, entirely at the teacher’s discretion, to terminate this Agreement with immediate effect by giving written notice of termination to the Parent or Carer. This right to terminate is without prejudice to any other rights the Teacher may have.
6. Conduct
If the Teacher, in their reasonable opinion, feels unable to continue tuition on account of unreasonable conduct by the Pupil or anyone connected with the Pupil, the fees for any outstanding lessons will not be refundable.
7. Communication
For the purposes of Conditions 1 and 3, written notice may be given on paper (through the school office), by email (to piapiapiapaul@gmail.com), or by SMS text message (to 07974 137693), provided that, in the case of an SMS text message, the recipient acknowledges the receipt of the text. For the purposes of Conditions 5 and 8, any written notice, statement or agreement must be recorded on paper or by email (and not by SMS text message).
8. Changes
(a) Any changes to the terms of the Agreement must be confirmed in writing and signed and dated by both the Teacher and the Pupil (unless over email in which case a confirmation reply to any changes will be acceptable).
(b) If the Teacher chooses to waive any right or remedy under this agreement or otherwise (for example, if the Teacher chooses to waive fees for any lessons which the Pupil does not attend) this shall not mean that they must do so in future or that they waive any other rights or remedies, unless agreed in writing in accordance with Condition 8(a) above.
9. Governing Law and Jurisdiction
This agreement shall be subject to the laws of the jurisdiction of the location for the lessons and the signatories to this agreement agree that any dispute relating to the subject matter of this agreement shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
